Meeting of Opposition leaders underway; Congress plans agitation for Rahul Gandhi’s sentence to 2 years, to meet President today.
The case was filed against Rahul Gandhi on a complaint lodged by BJP MLA and former Gujarat minister Purnesh Modi for remarks he had made at a Lok Sabha election rally in Karnataka’s Kolar on April 13, 2019
A day after Rahul Gandhi was convicted by a Surat Court in a defamation case and sentenced to two years in jail, the Congress has planned a massive agitation today and is set to meet President Droupadi Murmu along with other party leaders to discuss the verdict. Following the court verdict, Congress president Mallikarjun Kharge convened a meeting of senior party leaders and MPs at his residence where it was decided that a protest would be staged at Vijay Chowk on Friday, PTI reported.
Meanwhile, following the court’s verdict, sources from the Speaker’s office said they would take a call on Rahul’s disqualification as an MP after the order was brought to the table. “If a complaint with the order comes to the table, legal experts will examine and take a decision,” sources told The Indian Express.
While on13 April 2019, Rahul Gandhi gave a speech in Kolar, Karnataka, the Surat magistrate is highlighting while sentencing that Rahul had been cautioned by the Supreme Court to be cautious in future.
When was that contempt plea closed with the said remark against Rahul Candhi?
14th November 2019. Was he asked to be cautious in future or past?
Under sections 499 and 500 IPC Whoever defames another shall be punished with simple imprisonment for a term which may extend to two years, with a fine, or with both.
Why the highest punishment?
13 April 2019 was the date when Rahul Gandhi gave a speech in Kolar, Karnataka, Rahul had been cautioned by the Supreme Court to be cautious in future and the case was closed on 14th November 2019.
The Surat magistrate is now highlighting while sentencing that Rahul had been cautioned by the Supreme Court to be cautious in future.
Under sections 499 and 500 IPC, anyone who defames another shall be punished with simple imprisonment for a term which may extend to two years, with a fine, or with both.
Why did the court take the highest punishment for such a general comment?
It is strange that the complainant against Rahul Gandhi spent years trying to get a stay on his own complaint. However, as soon as the magistrate changed, the complainant withdrew all stay requests and the same new magistrate is the one who gave the new conviction.
It appears they are trying to lock Rahul Gandhi two years in a dungeon so Congress will lose the election, it is discerned. Can they really lock him up?
Why Is Rahul Gandhi Sentenced to Jail?
Congress leader and Wayanad MP Rahul Gandhi was on Thursday sentenced to two years in jail in a 2019 criminal defamation case filed against him for his alleged “Modi surname” remarks. Moments later, the court granted him bail and stayed its order for a period of 30 days so the Congress leader can appeal in a higher court.
The case was filed against Gandhi on a complaint lodged by BJP MLA and former Gujarat minister Purnesh Modi for remarks he had made at a Lok Sabha election rally in Karnataka’s Kolar on April 13, 2019. Reacting to the news, the former Gujarat minister said he “welcomed” the judgment. “Why all the thieves, be it, Nirav Modi, Lalit Modi or Narendra Modi, have Modi in their names,” the Congress leader had allegedly said during the rally.
