IndiaBhushan: High Court dismissed Joshimath residents' requests, imposed costs instead

Advocate Prashant Bhushan said, when residents of Joshimath went to the Uttarakhand HC on June 21, it imposed costs and dismissed the case.

Prashant Bhushan tweeted, “Shocking! The activists&residents of Joshimath had gone to the Uttarakhand HC on June 21(after the Rishiganga disaster of Feb 21, in which 150 workers were buried in the tunnel of the Tapovan-Vishnugad hydel tunnel)to stop the Hydel projects. The HC dismissed it by imposing costs!”

Journalist Shams Shams Ur Rehman Alavi responded by saying, “Not shocking as Hindi papers–Bhaskar, Jagran, Amar Ujala read by millions and each day are brainwashed.   Cunningly hide or push narratives. People go against their own future and interests.”

He went on to say, “Evil newsrooms. Don’t read or watch! The clip will reach ur mobile. #Media controls, such power on minds!  Officer, judge or politician, poor or rich, all controlled. Focus shifts to one incident, an actress’ statement, a murder or a suicide, a movie or a petty controversy can be carried, followed for months, wont let you focus elsewhere. Media is tool. No escape for society.” (sic)

Tanushree Pandey “Very scary situation unfolding in #Joshimath. Massive cracks and fissures in almost all houses, major hotels and roads. More than 700 families are impacted. Leaning buildings across the town.

Families tell me, “The govt knew everything since last year but never took any action.”

Vimlendu Jha expressed, “In any sane society n democracy, voices/opinions of experts/scientists is encouraged, more so to prevent any danger or mitigate the losses. Unfortunately, HM Shah has banned them from speaking on #Joshimath, n ISRO has now withdrawn its report on the sinking town. INSANELY irresponsible.”

A lady Manshi Asher responded,”Same as the Bajoli-Holi case where Shimla High court imposed costs on petitioners. Now what locals had foreseen is coming true.”

A preliminary report released Friday by ISRO’s National Remote Sensing Centre, revealing a “rapid subsidence” event in parts of Joshimath, was taken down from the NRSC website.

NDMA has instructed not to interact with media or share data on social media regarding ground subsidence at Joshimath in Uttarakhand, saying their “interpretation of the situation” is “creating confusion not only among affected residents but also among citizens of the country”.

The Supreme Court is scheduled to hear during the day a plea seeking the court’s intervention to declare the crisis in Uttarakhand’s Joshimath as a national disaster.

According to the cause list of January 16 uploaded on the apex court website, a bench comprising Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala would hear the petition filed by Swami Avimukteshwaranand Saraswati.

Joshimath, the gateway to famous pilgrimage sites like Badrinath and Hemkund Sahib and international skiing destination Auli, is facing a major challenge due to land subsidence.

On January 10, the top court refused an urgent hearing of the plea, stating there are “democratically elected institutions” to deal with the situation and all important matters should not come to it.

It had listed Saraswati’s plea for hearing on January 16.

“Everything important need not come to us. There are democratically elected institutions to look into it. We will list it on January 16,” the CJI had said, after the counsel appearing for the petitioner had mentioned the plea and sought its urgent listing.

The petitioner has contended that the incident occurred due to large-scale industrialization and sought immediate financial assistance and compensation to the people of Uttarakhand.

The plea has also sought direction from the National Disaster Management Authority to actively support the residents of Joshimath in these challenging times.

“No development is needed at the cost of human life and their ecosystem and if any such thing is to happen, then it is the duty of the State and Union government to stop the same immediately at war level,” the plea by the Seer said.

Stomach-churning

Netizens responded, “Why shocking? Judiciary has decided in favour of the Chardham project. The government projected it as a security need but why was this argument accepted by judiciary?

Another one said, “I know firsthand how petitions against any wrongdoings of any govt body are handled. N that’s we are where we are, in part of India. Stomach churning….”

Professor Ashok Swain said, “Not only Joshimath, but several other holy towns in India are also sinking. Space Research Organization has been asked to hide its findings and expert groups have been directed not to speak to the media. The regime is good at bulldozing houses, but not protecting them.”

Seetu Mahajan Kohli says, “Joshimath is the living proof of why all hilly areas need a special status. No outsiders should be allowed to buy land and build there. Whether it’s Himachal, Uttarakhand, J&K, Eastern states. Vernacular construction is the only way to preserve the hills.”
