Vijay Mallya was sentenced to four months in prison by the Supreme Court. He was convicted of contempt in 2017 over transferring $40 million to his children in violation of court orders.
The Supreme Court maintains that Vijay Mallya transferred $40 million to his children in violation of court orders. The court also imposed a fine of Rs 2,000 on Mallya. The apex court says, ” Vijay Mallya deserves imprisonment as he has neither shown remorse nor tendered an apology.”
The order was passed by a bench of Justices UU Lalit, S Ravindra Bhat and PS Narasimha. “If this is not deposited, the recovery officer can take appropriate actions for recovery of the said amount and the government of India and all agencies should assist in that process,” the court noted.
While sentencing him to jail the top court also asked Mallya to deposit the $40 million with 8 percent interest within four weeks to the Supreme Court legal services authority. A failure to do so would lead to attachment of properties and a further sentence of two months, the court said.
Mallya’s, who is in the UK since March 2016, counsel maintained that in the absence of any instruction from his client, he will not be able to argue on the quantum of sentence to be awarded in the contempt case.
